Welcome to Letmfly, a private expression platform operated by MPV.Tokyo ("we", "us", "our"). By accessing or using Letmfly, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Service Description

Letmfly is a private, non-public platform where users can freely express thoughts, feelings, and emotions—including frustration, anger, sadness, and other difficult emotions—without judgment. Your posts are visible only to you and AI characters that respond to your content.

Important: Your posts are encrypted and cannot be accessed or viewed by Letmfly's operators. We do not monitor, moderate, or review the content of your posts.

2. Eligibility

You must be at least 17 years old to use Letmfly. By using Letmfly, you represent that you meet this minimum age requirement.

3. Account Registration

You must create an account to use Letmfly. You are responsible for:

Maintaining the confidentiality of your login credentials
All activities that occur under your account
Providing accurate account information

4. User Content and Privacy

Your Content. You retain ownership of all content you post on Letmfly ("Content").
Encryption. Your Content is encrypted. We cannot access, read, or review your posts.
No Moderation. Because your Content is encrypted, we do not and cannot moderate your posts. You may express yourself freely, including using strong language or venting frustrations.
Self-Responsibility. You are solely responsible for your Content and any consequences that may arise from it outside of Letmfly.
Cooperation with Authorities. While we cannot access the content of your posts, we will cooperate with lawful requests from law enforcement and provide any available account metadata as required by applicable law.

5. AI Characters

Letmfly features AI characters that respond to your posts. You understand and agree that:

AI responses are generated automatically by language models and are not professional advice.
AI responses may contain inaccuracies, errors, or factually incorrect information. You should not rely on AI responses as a source of factual information.
AI responses should not be relied upon for medical, legal, financial, or mental health guidance.
AI characters do not have access to real-time information, current events, or context outside of what you share within the app.
AI characters are fictional entities, and their responses are designed for emotional support and entertainment purposes only, not for providing accurate guidance or advice.
The personality, tone, and content of AI character responses are determined by automated systems and may not always be appropriate, accurate, or helpful.

6. Prohibited Uses

While we do not monitor your Content, you agree not to use Letmfly to:

Plan, coordinate, or execute actual illegal activities
Create, store, share, or transmit any content that sexually exploits, endangers, or abuses minors (including but not limited to Child Sexual Abuse Material, or "CSAM")
Use the service to impersonate or sexualize minors
Use the service while you are under 17 years of age
Attempt to breach, hack, or compromise Letmfly's systems

7. Child Safety

Letmfly is intended for users 17 years of age or older. We have a zero-tolerance policy regarding child sexual abuse and exploitation (CSAE).

Any content that depicts, encourages, or facilitates the sexual exploitation or abuse of minors is strictly prohibited.
We cooperate with law enforcement and child protection organizations in response to confirmed reports of CSAE-related conduct.
Reports of suspected child safety violations can be submitted through our Child Safety Standards page.
Although user content is encrypted and not accessible to us, accounts associated with confirmed violations will be permanently terminated, and any available metadata will be provided to authorities as required by law.

8. Disclaimer of Warranties

LETMFLY IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

The service will be uninterrupted, secure, or error-free
AI responses will be accurate, helpful, or appropriate
Your Content will be permanently stored or recoverable

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LETMFLY AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, PROFITS, OR GOODWILL.

BECAUSE WE CANNOT ACCESS YOUR ENCRYPTED CONTENT, WE ACCEPT NO RESPONSIBILITY OR LIABILITY FOR:

The content of your posts
Any actions you take based on AI responses
Any emotional or psychological effects from using the service

OUR TOTAL LIABILITY SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).

10. Indemnification

You agree to indemnify and hold harmless Letmfly, its operators, and affiliates from any claims, damages, or expenses arising from:

Your use of the service
Your Content
Your violation of these Terms
Your violation of any law or third-party rights

11. Account Termination

By You. You may delete your account at any time through your account settings.
By Us. We may suspend or terminate your account if we believe you are violating these Terms or applicable law, or if required by legal authorities.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the app or by email. Continued use of Letmfly after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of Japan. However, if you reside in a jurisdiction where mandatory local laws apply, those laws will govern to the extent required.

14. Apple App Store — Additional Terms

The following additional terms apply if you obtained Letmfly from the Apple App Store. To the extent this Section 14 conflicts with any other provision of these Terms, this Section 14 controls with respect to your use of Letmfly on Apple devices.

14.1 Acknowledgement

You and we acknowledge that these Terms are concluded between you and MPV.Tokyo only, and not with Apple Inc. ("Apple"). MPV.Tokyo, not Apple, is solely responsible for Letmfly and the content thereof. These Terms do not provide for usage rules for Letmfly that conflict with the Apple Media Services Terms and Conditions.

14.2 Scope of License

The license granted to you for Letmfly is limited to a non-transferable license to use Letmfly on any Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that Letmfly may also be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.

14.3 Maintenance and Support

MPV.Tokyo is solely responsible for providing any maintenance and support services with respect to Letmfly, as specified in these Terms or as required under applicable law. You and MPV.Tokyo acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to Letmfly.

14.4 Warranty

MPV.Tokyo is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of Letmfly to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for Letmfly to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to Letmfly, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be MPV.Tokyo's sole responsibility.

14.5 Product Claims

MPV.Tokyo, not Apple, is responsible for addressing any claims by you or any third party relating to Letmfly or your possession and/or use of Letmfly, including but not limited to: (i) product liability claims; (ii) any claim that Letmfly fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation. These Terms do not limit MPV.Tokyo's liability to you beyond what is permitted by applicable law.

14.6 Intellectual Property Rights

In the event of any third-party claim that Letmfly or your possession and use of Letmfly infringes that third party's intellectual property rights, MPV.Tokyo, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

14.7 Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

14.9 Third-Party Terms

You must comply with applicable third-party terms of agreement when using Letmfly (for example, your wireless data service agreement must not be violated when using Letmfly).

14.10 Third-Party Beneficiary

You and MPV.Tokyo acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
